1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Bellsons AI ("Service"), operated by Bellson Consulting LLC ("Company", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

Bellsons AI is an AI-powered customer service automation platform that connects to your Facebook and Instagram business pages and automatically responds to customer messages using artificial intelligence. The Service includes:

AI-powered automated responses to customer messages via Facebook Messenger and Instagram Direct
A web-based dashboard for managing connected pages, AI configuration, and conversations
Billing and credit management for pay-as-you-go and subscription plans
Human handoff capabilities when AI assistance is insufficient

3. Account Registration

To use the Service, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Keep your password secure and not share it with third parties
Notify us immediately of any unauthorized use of your account
Be at least 18 years of age to create an account

You are responsible for all activity that occurs under your account.

4. Use of the Service

4.1 Permitted Use

You may use the Service only for lawful business purposes in connection with your legitimate Facebook and Instagram business pages. You must comply with all applicable laws and the platform policies of Meta (Facebook/Instagram).

4.2 Prohibited Use

You agree not to use the Service to:

Send spam, unsolicited messages, or engage in any form of mass messaging
Violate Meta's Platform Terms, Community Standards, or Messaging Policies
Harass, threaten, or harm any person
Distribute malware, viruses, or any harmful code
Impersonate any person or entity
Engage in any illegal activity or promote illegal products or services
Attempt to gain unauthorized access to our systems or other users' accounts
Reverse engineer, decompile, or disassemble any part of the Service
Resell or sublicense the Service without our express written consent

5. AI Responses and Accuracy

The Service uses artificial intelligence (powered by Anthropic's Claude) to generate responses to customer messages. You acknowledge and agree that:

AI-generated responses may not always be accurate, complete, or appropriate
You are responsible for reviewing and configuring the AI's knowledge base and behavior
You are solely responsible for the content of AI responses sent on behalf of your business
We do not guarantee that AI responses will meet your specific requirements
You should monitor AI conversations and use the human handoff feature when needed

6. Meta Platform Compliance

By using the Service, you authorize us to access your Facebook and Instagram pages through Meta's official API under the permissions you grant. You agree to:

Comply with Meta's Platform Terms and all applicable policies
Only connect pages you own or are authorized to manage
Ensure your use of automated messaging complies with Meta's messaging policies
Not use the Service in ways that violate Meta's policies on automated interactions

We are not responsible for any suspension, restriction, or termination of your Meta account or pages due to your use of the Service.

7. Billing and Payment

7.1 Pay-as-you-go Credits

PAYG credits are purchased in advance and deducted at $0.10 per AI response sent. Credits are non-refundable except as required by law. Credits do not expire.

7.2 Subscription Plans

Subscription plans are billed monthly in advance. By subscribing, you authorize us to charge your payment method on a recurring basis. Subscriptions auto-renew unless cancelled before the renewal date.

7.3 Cancellation

You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial subscription periods.

7.4 Price Changes

We may change our pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

7.5 Payment Processing

Payments are processed by Stripe. By making a payment, you also agree to Stripe's Terms of Service. We do not store your full payment card details.

8. Intellectual Property

The Service, including its software, design, and content, is owned by Bellson Consulting LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your business purposes.

You retain ownership of all content you provide, including your knowledge base, product information, and business data. By using the Service, you grant us a license to use this content solely to provide the Service.

9. Data and Privacy

Our collection and use of your data is governed by our Privacy Policy, which is incorporated into these Terms. By using the Service, you consent to our data practices as described in the Privacy Policy.

You are responsible for ensuring that your use of the Service, including the collection and processing of your customers' data through Facebook and Instagram, complies with applicable privacy laws including GDPR and CCPA.

10. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience downtime. We are not liable for any losses resulting from service interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, Bellson Consulting LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of revenue, profits, or business opportunities
Loss of data or customer relationships
Costs of substitute services
Any damages resulting from AI-generated responses
Any damages resulting from Meta platform actions or policy changes

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid us in the 3 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or meet your specific requirements.

13. Indemnification

You agree to indemnify and hold harmless Bellson Consulting LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

14. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service, other users, or third parties. You may terminate your account at any time by contacting us.

Upon termination, your right to use the Service ceases immediately. We may retain your data as described in our Privacy Policy.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the dashboard. Continued use of the Service after changes constitutes acceptance of the updated Terms.

Our website and dashboard use cookies and similar technologies to:
